Terms of Service

1. Who We Are

ScaleLounge is a done-for-you marketing service for entrepreneurs and small business owners, with self-serve AI tools. ScaleLounge is operated by ScaleLounge LLC, based in Scottsdale, Arizona, United States. The public brand is Katie Lendel / ScaleLounge.

These Terms of Service (the "Terms") apply to scalelounge.com, katielendel.com, and all ScaleLounge products and services, including the client portal, the free AI tools, our paid plans, and The Lounge. In these Terms, "we", "us", and "our" mean ScaleLounge, and "you" means you, the person using the sites or services.

By using either site, creating an account, or buying any plan or project, you agree to these Terms. If you do not agree, please do not use the sites or services.

2. What We Offer

ScaleLounge offers a range of plans and services. What you receive depends on the plan you choose or the written agreement we have with you.

• Free plan. AI content generation tools (hooks, social posts, blog posts, scripts, and emails) and an on-brand reply writer, saved in a personal client portal that you reach by a magic-link login. Free members have daily usage limits.
• Brand Trial. A one-time paid strategy sprint for $750. It includes a custom marketing strategy, a 30-day content calendar, 3 branded social graphics, and 1 SEO article.
• Growth Partner. A monthly done-for-you plan at $2,500 per month, typically 12 social posts, 2 short-form videos, and 4 SEO articles, created, posted, and managed, with a monthly check-in. Three-month minimum commitment.
• Scale Partner. A monthly plan at $5,500 per month, typically 20 social posts, 3 short-form videos, 8 SEO articles, and 4 email newsletters a month, plus a content calendar and priority turnaround. Three-month minimum commitment.
• Executive Partner. Available by application at custom pricing. Includes everything in Scale Partner, plus weekly strategy consulting, a priority direct line to support, and 20% off specialist projects.
• Specialist projects. Priced per project (a la carte), including sales funnels, paid advertising management, and website rebuilds. Scale members get 10% off and Executive members get 20% off these projects.
• The Lounge. A members-only community where members share wins, introductions, and questions on a wall, and can chat with an AI concierge.

The client portal lets you review and approve the content created for you, view your marketing strategy and content calendar, submit support requests, and access The Lounge. We may change, add, or remove features and plan details over time.

3. Your Account

To use the sites and services, you must be at least 18 years old and provide accurate, current information. You are responsible for keeping your account information up to date.

Accounts use a magic-link login sent to your email, so keep your email account secure and do not share your login links. You are responsible for all activity that happens under your account. If you believe your account has been accessed without your permission, please contact us right away.

4. Billing and Payments

All payments are processed by Stripe, a third-party payment processor. ScaleLounge does not see or store full card numbers. Prices are in US dollars and are exclusive of any applicable taxes.

• Brand Trial. A one-time charge of $750.
• Growth, Scale, and Executive. Recurring subscriptions billed monthly that automatically renew each month until you cancel. Growth and Scale carry a three-month minimum commitment.

If you buy the Brand Trial and continue to a monthly plan within 30 days, the $750 fee credits toward your first month. This credit is applied with a promotion code at checkout.

By starting a subscription, you authorize us and Stripe to charge your payment method on a recurring basis until the subscription is cancelled.

5. Cancellation and Refunds

You can cancel a subscription by contacting ScaleLounge, subject to any minimum commitment that applies to your plan. Growth and Scale have a three-month minimum commitment.

Because these are custom creative and done-for-you services, fees are generally non-refundable once work on a deliverable has begun. If work on a deliverable has not started, we may consider refund eligibility on a case-by-case basis. Recurring fees already billed for a period are generally not refundable on a partial-month basis.

6. Your Content and Ours

For deliverables we create for you under your plan, you receive ownership of, or a usage license to, the finished work, as specified by your plan or written agreement. Content you generate with the self-serve AI tools is yours to use for your business.

ScaleLounge retains all rights to its own platform, software, tools, templates, prompts, workflows, and brand. Nothing in these Terms transfers those rights to you.

We may display completed work in our portfolio, on our website, and in case studies and marketing, unless you have a written confidentiality agreement with us.

7. Acceptable Use

When you use the sites and services, you agree that you will not:

• Use the tools or services for unlawful, infringing, deceptive, harassing, hateful, or otherwise harmful content.
• Abuse or try to get around usage limits or security measures.
• Resell the services.
• Provide false or misleading account information.

We may moderate, edit, or remove content, and we may suspend or terminate accounts that violate these rules.

8. The Lounge

The Lounge is a members-only community. To keep it useful and welcoming, member posts are reviewed and approved before they appear publicly.

In The Lounge, please be respectful. No spam, harassment, or self-promotion abuse. We may remove content or accounts that break these rules.

9. Third-Party Services

Our services rely on trusted third-party providers, including Stripe for payments, social platforms for publishing, and AI providers that power the content generation, among others. These services are governed by their own terms and privacy policies.

We are not responsible for the acts, outages, delays, or failures of third-party services outside our control.

10. Disclaimers

The services are provided "as is" and "as available," without warranties of any kind, to the extent permitted by law. ScaleLounge does not guarantee any particular marketing result, revenue, reach, or business outcome. Marketing results depend on many factors, and your results may vary.

11. Limitation of Liability

To the fullest extent permitted by law, ScaleLounge is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the sites or services. Our total liability for any claim relating to the services is limited to the amount you paid us for the service giving rise to the claim.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated version here. Your continued use of the sites or services after an update means you accept the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Arizona, in the United States, without regard to its conflict-of-law rules.
